KOHOM ORGANICS — TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of the website, mobile applications, and online services operated by Kohom Organics (“Company”, “we”, “our”, “us”). By accessing or purchasing from the Platform, you agree to be bound by these Terms.

 

1. Eligibility

You must be 18 years or older to use or purchase from the Platform. Minors may use the Platform only under the supervision of a parent or legal guardian.

2. Account Creation

You are responsible for:

  • Maintaining confidentiality of your login credentials

  • Restricting access to your device

  • All activities under your account

We may suspend or terminate accounts for fraudulent activity, misuse, or violation of these Terms.

3. Products & Availability

All Products listed on the Platform are subject to availability.
 We reserve the right to:

  • Modify or discontinue Products

  • Change pricing at any time

  • Limit quantities per order/customer/address

Product descriptions and images are for representation; minor variations may occur.

4. Pricing & Payment

Prices are displayed in Indian Rupees (INR).
We accept major payment methods: UPI, credit/debit cards, net banking, wallets, and COD (selected locations).

We reserve the right to refuse or cancel any order due to:

  • Payment issues

  • Suspicious/fraudulent activity

  • Pricing or stock errors

5. COD Terms

By placing a COD order, you agree to:

  • Accept the delivery

  • Keep exact payment ready

  • Avoid misuse (multiple refusals may lead to COD restriction)

6. Intellectual Property

All content, design, logos, product information, formulations, photographs, trademarks, and material on the Platform belong to Kohom Organics.
You may not copy, reproduce, modify, sell, or exploit any content without our written permission.

7. User Content

When submitting reviews or feedback:

  • You grant Kohom Organics a non-exclusive, royalty-free license to use such content for marketing, improvement and display.

  • You are solely responsible for the accuracy and legality of such content.

8. Prohibited Use

You agree not to:

  • Violate laws or third-party rights

  • Misuse the Platform

  • Upload harmful code, bots, scrapers

  • Attempt unauthorized access

  • Impersonate another person

  • Manipulate transactions or pricing

9. Shipping, Returns & Refunds

All shipping, return, refund and cancellation terms are governed by Kohom Organics’ Shipping Policy and Returns Policy, which form an integral part of these Terms.

10. Disclaimer of Warranties

Products sold by Kohom Organics are topical skincare items. Results may vary depending on skin type, conditions, and usage.
We make no warranties beyond those required under Indian law.

Recommendations provided on the Platform are for informational purposes only and do not substitute professional medical advice.

11. Limitation of Liability

To the maximum extent permitted by law, Kohom Organics is not liable for:

  • Indirect, incidental, consequential losses

  • Allergic reactions or sensitivity (patch test recommended)

  • Delays due to courier partners or external factors

  • User negligence or misuse of products

Our liability is limited strictly to the value of the product purchased.

12. Indemnification

You agree to indemnify and hold Kohom Organics harmless against claims arising from:

  • Misuse of the Platform

  • Violation of these Terms

  • Infringement of third-party rights

  • Submission of unlawful content

13. Privacy

Use of the Platform is governed by our Privacy Policy, which explains how we collect, use and protect personal information.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

In the event of any dispute or disagreement, the parties shall first attempt to resolve the matter through mutual discussion and negotiation. If the dispute remains unresolved, it shall be escalated to the Grievance Officer in accordance with applicable laws.

If the dispute is not resolved thereafter, it shall be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996.

Subject to the above, the courts in Maharashtra, India shall have exclusive jurisdiction.

15. Modification of Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
